Privacy The relationship between privacy and freedom of the press is very complex and is regulated by a set of rules that, over the years, are trying to establish a proper balance between the different interests fielded. There are rules designed to protect the privacy of individuals, which journalists must follow during the performance of their work: •On July 8, 1993 the National Council of Journalists and the National Federation of the Press approved the Bill of duties of the Italian journalists. This document is significant in that it seeks to protect freedom of information, also intended as passive duty of the community. The bill is divided into four key issues: personal rights, duty of rectification, presumption of innocence, and professional incompatibilities. The part concerning personal rights, as well as prohibiting any kind of discrimination based on race, religion, sex, etc.., says that no one can publish news about the privacy of individuals. This section also includes the contents of the Carta di Treviso for the protection of children and vulnerable people. In particular, it underlines the obligation to protect the anonymity of a child and the commitment to avoid the presence of minors in television broadcasting which may damage their personality. It is then stated the prohibition to make the three following categories identifiable: 1.victims of sexual violence, 2.members of the security forces and judicial authorities, The bill also introduces a National committee for the accuracy and fairness of information, a body whose function is to collect and assess reports of citizens who believe they have been offended by a newspaper article. •The law of 31 December 1996, no. 675 ensures that personal data shall be processed respecting the rights, fundamental freedoms and dignity of individuals. Article 25 is titled Treatment of specific data in the exercise of the journalistic profession, and prohibits to disclose data related to health and sex life of citizens without consent, and entrusts the Guarantor is to promote the adoption, by the National Council of the Order, of a code of ethics relating to the processing of personal data. •The Code of ethics for the processing of personal data in the exercise of the journalistic profession has been delivered to the Guarantor in its final version on 29 July 1998, pursuant to art. 25 of law 675/96. The key of the code is the distinction between private and public interest. It consists of 13 articles, dealing with the protection of certain personal rights such as the right to privacy on ethnic origin, political thought, sexual habits, religious beliefs, health, the right to dignity of defendants and sick individuals. Very important is art. 6 of the Code, which speaks of the essential information and makes it clear that the news may be conveyed, even in detail, if it is indispensable as for the originality of the fact, the description of the particular ways in which it occurred, and the qualifications of its protagonists. Even in the code, art. 7, the need expressed in the Carta di Treviso, for reinforced protection of minors is stated. In the case of missing or abducted children, in particular, parental consent is required. Article. 8 states, on the other hand, in the sphere of respect for the dignity of persons, the prohibition of publication of disturbing images.
